Service Agreement
This page is the "Service Agreement"
for services purchased on the JobSpectrum.org
web site. By purchasing JobSpectrum.org services,
you are accepting that you are bound by the terms
of this Service Agreement. The American Chemical
Society (ACS) may revise this Service Agreement
at any time by updating this posting. The terms
"You" and "User" are used
to refer to any one who is purchasing JobSpectrum.org
services
Acceptance of Terms and
Conditions of Site Use
User accepts the terms
and conditions associated with the use of
this site and all affiliated services. Click on
button to see the Terms and Conditions associated
with this agreement.
Description of Services
The American Chemical Society's JobSpectrum.org
services may be accessed in the standard Internet
formats using HTML and Adobe Acrobat PDF format.
ACS reserves the right to change formats without
notice. It is the responsibility of the User to
establish and maintain at User's expense Internet
connections to the ACS, to provide and install
suitable Web browsers, licenses for Adobe Acrobat,
and any other software necessary to view JobSpectrum.org
services.
Acceptance of Services
By purchasing JobSpectrum.org services you accept
the terms and conditions of this agreement and
that you will comply with our policies and standards.
ACS takes no responsibility for the content posted
by you through JobSpectrum.org services however
we reserve the right to reject any content at
our discretion.
User accepts the fee(s) associated with purchasing
JobSepctrum.org services. ACS may terminate your
services at any time without notice and will refund
only those fees for which service was not rendered.
Users, including but not limited to Advertising
Agencies, who are purchasing services on behalf
of multiple clients must register and establish
a separate account for each client purchasing
services other than the single ad posting.
Terms of Payment of Services
User agrees to pay the fee(s) due in advance,
or upon approval of credit, net ten days upon
receipt of an invoice from JobSpectrum.org. A
purchase order number is required for payment
by invoice. Service will be terminated if JobSpectrum.org
does not receive payment when due.
Waiver of Warranties
THE CONTENT THAT IS POSTED ON JOBSPECTRUM.ORG
MAY CONTAIN INACCURACIES OR TYPOGRAPHICAL ERRORS.
ACS MAKES NO REPRESENTATION ABOUT THE ACCURACY,
RELIABILITY, COMPLETENESS, OR TIMELESS OF THE
WEB SITE OR THE CONTENT POSTED.
THE WEB SITE AND MATERIAL ARE PROVIDED ON AN
"AS IS" BASIS WITHOUT ANY WARRANTIES
OF ANY KIND. ACS, TO THE FULLEST EXTENT PERMITTED
BY LAW, DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS
OR IMPLIED, INCLUDING THE WARRANTY OF MERCHNTABILITY,
FITNESS FOR PARTICULAR PURPOSE AND NON-INFRINGEMENT.
ACS MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY,
COMPLETENESS, OR TIMELINESS OF THE MATERIAL, SERVICES,
SOFTWARE, TEXT, GRAPHICS, AND LINKS.
ACS DOES NOT WARRANT THAT THE WEB SITE WILL OPERATE
ERROR-FREE OR THAT THE WEB SITE AND ITS SERVER
ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL
MERCHANISMS. IF YOUR USE OF THE WEB SITE OR THE
MATERIAL RESULTS IN THE NEED FOR SERVICING OR
REPLACING EQUIPMENT OR DATA, ACS IS NOT RESPONSIBLE
FOR THOSE COSTS.
Terms of Agreement
User agrees not to resell or assign your rights
to use JobSpectrum.org services under this agreement.
You agree not to make any unauthorized commercial
use of this Website.
User is responsible for fees associated with
third parties purchasing JobSpectrum.org's services
on your behalf.
If you access the site from outside the United
States you do so at your own risk
Governing Laws
These Terms and Conditions are governed by the
internal substantive laws of the District of Columbia.
Jurisdiction for any claims arising under this
agreement shall lie exclusively with the state
or federal courts within the District of Columbia.
If any provision of these Terms and Conditions
are found to be invalid by any court having competent
jurisdiction, the invalidity of such provision
shall not affect the validity of the remaining
provisions of these Terms and Conditions, which
shall remain in full force and effect. No waiver
of any term of these Terms and Conditions shall
be deemed a further or continuing waiver of such
term or any other term.
